Passenger rights in cases of flight disruptions

No matter whether we are travelling for business or just want to go on holiday: We assume that a booked flight will get us there on schedule. However, considerable delays, overbooking or even cancellations do happen. Fortunately, EU Regulation No. 261/2004 regularly entitles passengers to a lump-sum compensation in such cases, which is intended to remunerate the travelers affected for their inconvenience.

In addition, the EU’s Air Passenger Rights Regulation also provides for other rights in the event of flight delays or cancellations, such as entitlements to snacks, ticket refunds and a hotel accommodation that might become necessary. These provisions are further complemented by German jurisdiction that entitles a passenger on flights to, from and within the country to a reimbursement of taxes and fees saved by the airline if the traveler cancels his booking. Moreover, these passenger rights are supplemented by other travel law provisions such as the Montreal Convention, which primarily sets out the terms of compensations for delayed, damaged or lost baggage.

Our service in case of a flight irregularity

Whoever suffers a flight irregularity might therefore qualify for to a lump-sum payment by the airline under EU Regulation No. 261/2004. Likewise, passengers cancelling their trips are usually entitled to a partial refund of the fare they paid. Yet, as is well known, it is not enough to be in the right if you cannot win. This general principle definitely applies to air passenger compensations: From our experience we know that airlines often leave claim letters unanswered, reject requests for compensation or only hand out vouchers instead of cash payments (to which they are obligated, though).

Conditions for your flight compensation

In order for us to be able to offer you an instant compensation in the event of a flight cancellation or delay, certain conditions have to be met: First, it is important that your flight either started or arrived in the EU. In the latter case, the flight must have been operated by an airline headquartered in the EU as well. In any case, not only intra-European flights are eligible for compensation.

Furthermore, a compensation under EU Regulation No. 261/2004 prenecessitates that you have made a valid booking and arrived at the departure airport early enough to check-in on time. Besides, the flight irregularity you suffered must not have occured due to factors beyond the airline’s control (e.g. force majeure).
